Negligent beauty treatment - Laser burn claim resulting in £34,000 compensation.
The owner of an aesthetics clinic was left with permanent facial scarring from high intensity ultrasound treatment from Lynton Lasers Ltd. A five-figure compensation settlement was reached.
Beauty claim for laser burns and scars caused by an in-clinic laser treatment.
Rachel, the owner of a beauty clinic, received a significant five-figure sum as compensation for her burn injury. This beauty injury occurred after she received an ultrasound treatment by an employee of Lynton Lasers Ltd. As a result of the treatment, Rachel was left with permanent scars on her face.
A Lynton Laser Ltd representative offered to undertake a demonstration of a High Intensity Focused Ultrasound Machine known as HIFU at Rachel’s clinic in Greater London. Rachel was looking forward to the treatment and seeing the positive results that were promoted by Lynton Laser Ltd.
Rachel stated “I always do my research before introducing new aesthetic procedures to the clinic and I was looking forward to seeing the results of the HIFU treatment on myself before making a decision. I never imagined what I would go through and I was devastated by the outcome."
Prior to the HIFU treatment being undertaken, no consultation in relation to her medical history took place by the treating laser technician. During the treatment Rachel reported pain to the aesthetician, but despite this the treatment continued. Almost immediately after the treatment had started, large inflamed raised lines became visible on her face.
The facial injuries and trauma from the beauty treatment
Following the procedure, Rachel was left with over 30 raised linear marks on her cheeks. As Rachel works in the aesthetic industry herself, she suffered psychological trauma which impacted her day-to-day life. She was highly embarrassed by the scarring, and avoided showing her face as much as possible. Rachel was unable to work for several weeks and was self-conscious and anxious about her clients questioning her skills in the services she provided given her own appearance.
Due to the visible facial injury suffered, Rachel had to undergo a series of intensive treatments to improve the facial scarring left by the 30 burns. After 14 months of prescribed topical medication, chemical peels, PRP treatment and more, Rachel’s scarring remained visible and was causing her extreme distress.
In this case, the negligence of Lynton Lasers Ltd included failing to:
- Conduct an adequate risk assessment prior to the treatment
- Ensure Rachel’s safety during the treatment
- Provide any warning of the potential adverse effects the treatment may have
- Provide adequate training to employees carrying out the treatment
Lynton Lasers Ltd admitted liability and the beauty injury claim was settled for a five-figure sum.
The name of the client has been changed to protect her privacy.
My client underwent what should have been a routine cosmetic treatment, yet the defendant’s negligent training and lack of safety precautions resulted in her being left with facial scars for life.
