Workplace Injury - Mindu's story

We acted for Mindu whose husband worked at a factory in Birmingham which was due to be shut down within a matter of days of his death. He had been employed there for several years as a shot blast operator and forklift truck driver. The factory was in the process of decommissioning with a view to closure.
Mindu's husband was driving a forklift truck with an empty hopper on the fork and the right wheel struck the end of a concrete kerb set in the floor causing the forklift truck to tilt to the left and tip over.
As the forklift truck fell on its side, he was trapped causing a traumatic blunt head injury from which he immediately died. We commenced court proceedings in the High Court for Mindu and her two dependent children and the matter settled out of court.
