Mercedes-Benz NOx Emissions Group Litigation Statement of Truth

You are required by the Court to confirm the accuracy of your SOCI by verifying a Statement of Truth.

This is contained on your SOCI and states: “I believe that the facts stated in this [SOCI] are true. I understand that proceedings for contempt of court may be brought against anyone who makes, or causes to be made, a false statement in a document verified by a statement of truth without an honest belief in its truth”.

You will note proceedings for contempt of court may be brought against anyone who makes, or causes to be made, a false statement in a document verified by a Statement of Truth without an honest belief in its truth.

It is therefore very important that to the best of your knowledge the information contained in your SOCI is accurate.

Once you access the SOCI Questionnaire please do not press “Next” and navigate to the next page until you are satisfied that the information on that page is correct.

You will not be able to navigate back a page so please ensure the information on each page is correct before pressing “Next”.

You do not need to email to inform us of any inaccuracies or any amendments you have made as changes made are applied directly to our database.

You will be prompted to verify the Statement of Truth (“SOT”) on the last page of the Questionnaire.

To verify the SOT and confirm that the information contained in your SOCI is accurate, select the SOT tick box and then press “Next”.

Once you have selected “Next” you have verified the SOT and confirmed that to the best of your knowledge the contents of your SOCI are accurate.

You will be emailed a copy of your SOCI. Should you then realise some of the information entered is incorrect then please “Reply” to that email or email Emissions@LeighDay.co.uk with the email subject line “SOCI_FL”.

Please do take the time to check each page of the Questionnaire is accurate.

Once you have verified the SOT we cannot guarantee any further amendments you may request will be incorporated into your SOCI.

Statement of Truth: Authorisation

By signing your Statement of Truth you will have further authorised us to use your Statement of Truth (or to sign it on your behalf) to present your case in the final version of your SOCI that is served on the Defendants.

Where we sign the SOCI on your behalf this is based on your honest belief of the facts contained in your SOCI.

Once you have verified your Statement of Truth and your SOCI has been submitted to us we will review any changes you have made and the contents of your file and prepare your SOCI for service.

  • We may need to obtain further instructions from you. If that is the case, we will contact you – please help us by responding promptly.
  • We may also make formatting changes to your SOCI where necessary to comply with the requirements of the SOCI format. We make these changes as your legal advisors with the aim to present your case in accordance with the court ordered SOCI questions. As these are only changes to how your SOCI is formatted we may not communicate these changes to you.
  • We reiterate that by signing your Statement of Truth you authorise us to use your Statement of Truth (or to sign it on your behalf) to present your case in the final version of your SOCI served on the Defendants.
  • Should we make any material changes to the contents of your SOCI after you have signed the Statement of Truth, we will communicate these changes to you, explain why we have made the changes, and give you opportunity to review and query any changes we have made. If you do not agree with any material changes made, please ensure you inform us of this as soon as possible to confirm you are not authorising these changes. Please note we will proceed on the basis that you have authorised the changes set out in our email if you do not respond within the timeframe provided.
